Wednesday, September 1, 2004 Will dismissal be for good? -------------------------------------------------------------------------------- ESPN.com news services Kobe Bryant's legal drama may soon be over. ABC News is reporting Wednesday afternoon that the prosecution in the Bryant case will ask the judge later in the day to dismiss the case with prejudice, meaning the case cannot ever be brought back for trial. According to the report, the accuser has told prosecutors she is no longer willing to testify. District Attorney Mark Hurlbert scheduled a late afternoon news conference, then canceled it to attend the court session, which stretched into Wednesday evening without word of a decision. His spokeswoman declined comment before that, as did attorneys for the 20-year-old accuser. Defense attorneys did not return calls seeking comment. NBC News was reporting that the request for dismissal would be without prejudice, meaning a future trial would be possible. ESPN legal analyst Roger Cossack, however, told ESPNews that it would be unlikely for a judge to grant that request after more than a year of pre-trial hearings and the start of jury selection. Even if the criminal charges are dropped, Bryant still faces a civil suit that was filed by his accuser earlier this summer. The news of the case's possible end comes on the heels of Bryant's defense attorneys filing for dismissal earlier Wednesday, saying prosecutors have refused to turn over details that could suggest he is innocent. Court rules require prosecutors and defense attorneys to exchange evidence and witness opinions before trial, a process called discovery. In a motion made public Wednesday, defense attorneys said a forensics expert whom prosecutors had planned to call as a witness had information that "undermined the accuser's allegations and the prosecution's case, and corroborated Mr. Bryant's defense on a central issue -- the cause and significance of the accuser's alleged injuries." The filing said those opinions were not disclosed to the defense until they contacted the expert Friday, despite repeated requests to prosecutors for the information. "A person's life and liberty are at stake," the defense attorneys wrote. "The game of hide-the-ball, find-it-if-you-can discovery is intolerable. This court must vindicate Mr. Bryant's constitutional rights and impose meaningful sanctions against the prosecution." Prosecutors have said they have turned over all information they were required to. Bryant, 26, has said he had consensual sex with a then-19-year-old employee of a Vail-area resort where he stayed last summer. If convicted, the Los Angeles Lakers star would face four years to life in prison or 20 years to life on probation, and a fine up to $750,000. Information from The Associated Press was used in this report.

Kobe ought to slap her with a 100 million dollar slander / defamation of character suit now....since it'd be pretty easy to prove this incident will end up costing him that in endorsements EASILY. It'd be a good deterrent for anyone else thinking about trying to set up a celebrity or athlete with financial gain as their motive.

I think if she wanted just money, she wouldn't have people scrambbling to post her pics on websites.. She stayed out of media view for some reason.. Most chicks who wanted money (the chick Tyson raped, the one who said Rodman gave her herpes) were all in the cameras..
Maybe she was a closet-golddigger..

PAYOFF PAYOFF PAYOFF PAYOFF PAYOFF!!!!!! The scales of Justice are now and have always been, balanced with MONEY. Paraphrasing a line from the Godfather; "He made her an offer she couldn't refuse". Yea, all she wanted was attention AND MONEY, but can you believe how stupid Bryant was for doing it in the first place? What an idiot!! Of course, there are many more like him. BB

I don't know why all of you are so sure he is innocent. Were any of you there? Maybe you were in the courtroom and heard evidence? Oh wait, that couldn't be since the jury wasn't even seated. I guess that means all of you don't know shit!
Here's a plausable explanation as to why she won't testify: How about she FEARS FOR HER LIFE. Since the inept judge in the case allowed her real name and personal info to be leaked during pretrial hearings (in DIRECT violation of Co Rape Shield Laws) not once but multiple times, the girl and her family have had several death threats and at least one individual was arrested for making death threats. I have not heard this girl on the news even once. If she was after money and attention, she would have been all over the airwaves, getting book deals, etc. She has done her dead level best to stay out of the public's attention. How does that square with her "wanting attention"? Why does everyone always side with the rich and famous? That is both illogical and infuriating. What if he had been some poor black guy from the projects? Would you still be taking his side over a pretty little white girl? I have my doubts. I am not saying he is guilty but neither am I saying he isn't. I don't have all the facts with which to make that assessment and neither do any of you. |

i'm not siding with the rich and famous. but since there was sperm found inside of her that did not belong to kobe from the rape exam, i have a hard time believing that she's not doing this for attention and money.
i think that even if kobe was a guy from the ghetto, and the same information came out about the "alleged" rape victim, i would side with him still. i mean, c'mon, to show up at a rape exam with other men's sperm inside, on your panties, and on the inside of your legs? tell me that doesn't sound like crazy slut to you? |

what's also funky to me and an indication that the small county prosecutor just wanted some fame is that a warrant was issued for his arrest BEFORE the prosecutor decided to charge him with anything. and also, what about the whole deal with people in the sheriff's office ordering those shirts that said "hang kobe"?
i think that in this specific case - the rape shield law was unfair to accused party - there's obviously more that we don't know, but there's been enough information that's come out to paint a bad picture of her. i can tell you that i couldn't be impartial on that jury. |

she was a slut. she was screwing guys right before and right after coby. somebody screwed her even before she went in for a rape exam if im not mistaken. if your having sex with someone else right after you got raped then she must not have been to worried about it.
here is what happened. this girls has a golden oppertunity to screw a million air super star. after thats done she has yet one more golden moment and says to herself, "hey wait a minute, i can make alot of money of this guy". so she decided to scream rape. end of story case closed.

Good point, Spidey. It is a sad sordid affair and Kobe as a married man should be ashamed of his conduct, consensual or not.

Spidey--Spidey, I never said he was innocent, I thought from the first day he was probably guilty. He admitted to having sex with her, whether he forced her or not is only known by them. But, if she would have admitted that she did have consensual sex with him, that would have gotten her squat. So she had to yell RAPE, to get the bucks. My best guess is that she flirted a bit too much and it got out of hand and when he whipped out the meat whistle everything changed. But still, he was an idiot for doing it whether or not it was consensual. Not because it was the wrong thing to do since he was married, which it was, but because someone like him, with plenty of bucks is just asking for this shit. He's paying either way, he just doesn't have to go to jail and be someone's bitch. BB
