Differeng from state to state. You are best to actually call the majistrate's office and find out. Most of the time, it consists of a letter to the judge that convicted you. The letter should contain things like "I have not committed any midemeaners or crimes and feel that I have been fully remediated and matured since the incident..." Something like that.

I am going to be doing something similar to get a couple of MDs off my record too. I have agg. assault, harassment and disorderly conduct from when I was 14 years old. It was nothing more than picking on a kid who tried to run away, tripping over his own feet and hitting the pavement. They said I was responsible for his injuries and charged me out the ass.

Hell, you need a lawyer just to pressure credit reporting agencies to remove FALSE or inaccurate instances of credit defaults and to protect your rights if you have been a victim of identity theft. For an expungement of charges/convictions on a legal record, I would go the professional route.

I once had to threaten suing an auto insurance company that would not remove me from an insurance driving pool many years ago due to an accident that I was ultimately not even held responsible for. The legal limit where I live was to keep violations or accidents (for insurance records) on record for 7 years. This means increased insurance premiums out the ass for very minimal coverage. I asked them to revise the record after 8 years but they refused to do so. I took my own course of action for the next 2 years without success. It was already 10 years with a clean driving record and they were still trying to justify higher premiums when I hired a lawyer and had a letter from the State Attorney General sent to them to break their asses and they finally caved in. Fuckers!

^^^Damn, I would have asked for money back that was owed to you over those last couple years that they shouldn't have been charging you too.

It's virtually impossible to recoup anything like that. The court costs would outweigh any possible returns. Also, a decision in your favor is one thing but actually receiving payment is a whole different thing Getting them to fix it was a small victory in itself. I'm happy to get that, lol.
