    In Florida if you don't blow you lose your license for a year , regardless! If you do blow and you are over the legal limit, they have that little piece of paper that says you WERE DUI! I know several attorneys, that hang out at Hooters, that say don't blow! Don't do the road side sobriety test! Just be calm, nice and cooperative! Do not give them anything they can use against you!!!

      I agree that cops are looking for dui's at 2am, and probably pull over a lot of people out of suspicion for no real reason, thinking they've probably been drinking. But if you haven't, you have nothing to worry about. As far as the BAC, I think the legal limit needs to be zero. You can't tell people, well it's ok to have a few and drive, but don't have those extra three sips or you're going to be over the limit. I could have 3 drinks on 3 different days and depending on what I ate, and how long it took me, I'd have three different BACs. Plus, once you start drinking, and haven't made alternative plans for a ride, you're probably not going to stop thinking that you need to keep your bac below .08 (or whatever it is in your state)

        Just don't drink babe and that would solve the problem all together, lol :)

          The police ARE looking for drunk drivers at 2 am in the morning. Its their job. If you have ever peeled someones face off a windshield because some fathead didn't know when to say when it would enlighten you greatly as to why DUI enforcement is neccessary. Bottom line is you are an adult and responsible for your actions. Know the law, know your rights and make the proper choices to make sure everyone on the road is safe. .08 doesnt take a whole lot to get too.

              I am against drunk driving as most of you all are, but some of us can have a couple of drinks and are perfectly capable of driving better than some who had had only one beer. I read a review of that tape that is for sale and the bottom line was to act calm, and not take the breathalyzer if you think you will be over. You can also delay the test by various measures until you alcohol level drops possibly. The officer has to make sure you don't belch for 20 minutes prior to the test. They rarely wait that long, thus the procedure is invalid. In the tape, an attorney drank a considerable amount and could consistently blow below .08. His technique was a steady blow instead of a quick deep blow because the machine works on some kind of peak variation principle, whatever that means. Lastly, what pisses me off about the whole issue is the way our rights are violated with roadblocks and stops for no reason. What country has roadblocks up all over in the night and has fidgety, armed cops that put a flashlight in the drivers face while asking him/her stupid questions? We are all smart enough to know that you had best call the cop, Sir, and act very safe. It is an invasion of privacy and mimics the tactics used in North Korea or Iran. I have been stopped at one and was not drinking, but the invasion of privacy made me feel totally violated.

                I dont respond to these very often but I just had to after that last one. First, lets talk about the rights thing a minute. If peoples total disregard for the law to begin with wasn't an issue than roadblocks and other means wouldnt be neccessary. To compare this country to Iran or North Korea is the most ludicrous thing I have heard. Iran is a fundamentalist Muslim country and if you drank and drove there in all likely hood you would be killed outright not stopped at a chippy roadblock. North Korea is probably the last vestige of failing communism as even China has open its gates to capitalism. To compare our country with one that has such a tolatarian regime that you would be killed in public for even subscribing to a website like this is asinine. The bottom line is that people who are irresponsible and disregard everyones rights are the ones that set the bar for law enforcement in this country. If mouth breathing air thieves that can't decide whether or not to put the seat up, much less if they have had too much to drink, continue to kill people by driving drunk you can bet the laws are going to get tougher. If you make good choices for yourself then you dont have a thing to worry about. I for one dont mind a flashlight in my face if the guy behind me is plowed out of his mind. I dont drive drunk so I dont worry.

                As for the tips on the breath machine, there are far to many flavors of diagnostic computers out there give concise advice for how to fool it. The ones where I am from require a lonnnnng steady breath for a good result and failure to give one can be a refusal. The belching thing isn't an issue over here either but preventing anything from entering or exiting the mouth for 15 minutes is mandatory...

                  I actually live in So. San Francisco, about 10-15 mins from pac bell park. I would say i live in the suburbia of so. sf, but nobody knows where the hell that is. lol

                    :agree: Well the wait is over. A $527 fine, nine months probation, DUI School, 50 hours community service for a first offense! My attorney tried his best to get the trooper to say that he had pulled me over to check on my well being! If he had it would have been thrown out! But he didn't and with the evidence against me I pleaded No Contest and got the minimum! It sucks but it is a lesson learned! No more following chicks back to their place to get laid at 2:30 in the morning! Damn...women always get me in so much trouble!:P
