Just out of curiosity....does anybody know how severe Public Intoxication charges are?? And is it a misdemeanor(sp) or felony or even anything to worry about?? Id appriciate the help alot

Not severe at all. I believe that it is usually just a small fine, along with maybe spending one night in the drunk tank,

lol yeah I went to a football game after a couple shots of jack, wasnt wasted though the cops just "smelled the presence of alchohol"....I didnt take the breathalizer though. I jsut had to go to jail but got out the same night. What Im wondering is if they can prove that I was drunk since they didnt breathalize me or if I can prove that I wasnt for the same reason if I decided to try to get it dropped

Were you cited or just taken into custody? Totally depends on what state you are in.

Lame ass cops. You either cant hold your alcohol, or they were being pricks. Because there is no way you were intoxicated enough for them to detain you after only a few shots.

yeah man I wasnt drunk at all, they just "smelled the presence of it" & handcuffed me & took me in but let me leave the same night.....if I was drunk I thought theyre sposed to keep me over night??? dumbass cops

fine, jail 1 or 2 days, suspended licesce, and maybe community service hours and stays in your record.:(

I would recommend getting an attorney just to be safe. I was given a ticket for drinking a beer in the parking lot before a concert in Phoenix. I figured it was no big deal, just a ticket right? I paid it and forgot about it. I find out 3 years later that it was actually a misdemenor(sp?) offense when it showed up on a background check for work. Oops. I had checked the box on the app. that said I had a clean record, almost lost the job right after I got it because of it. I could get it expunged from my record but I no longer live in AZ and it is a big pain in the ass to do from out of state. Anyway, I would make sure you know what you are dealing with. Better to know now than have a suprise down the road.:drunk:
