  • Overtime Labor Laws?

    I know the states have labor laws that determine when overtime pay starts. Is it possible to sign an agreement stating you will take your regular pay when working extra hours? People are going on vactions the next couple months here and there. I would like to cover the shifts to make extra money this year and it's hard to find a second day time job. They don't want me to work overtime though.

    depends on who you work for. i know the government jobs couldn't make that type of agreement. but a private company could unless the union bitched about it (they usually have something to bitch about).

        My wife is an accountant and works on an agreement that all overtime is straight time or comp time, so it must be possible.

          I wouldn't work overtime if I didn't get my time and 1/2 after 40. in fact I wouldn't take a job that didn't have the arangment unless I was on salery

            varies according to state, and sometimes even city. if i knew what state you were in i could give you specific web-sites etc., but just pull up google and type in "Labor & Industries," and your state. should be easy to find, some states even provide a variety of the forms you would need in pdf format. good luck.

                  I'm sure you both do :P, but the fact is getting straight time is still more money then getting no extra time. I have to think about my baby due the begining of Sept. Beggers can't be choosers.

                    Bro just talk to the management and explain your situation about wanting to work and needing the money....hopefully they are softhearted enough to understand and pay you the overtime. If you work the extra hours once without getting paid the overtime for it they will expect that from you everytime....IMO!

                      that's a good idea but if their policy is not to pay time and a half then they're not gonna change it for him. no offense shibby but they'll look at it like if they do it for you then they legally have to do it for everybody. i was always under the impression that ot was always time and a half, aside from salary. good luck bro. and yes something is better than nothing.

                        Talk to your manager, he may be able to work it out for you. Larger chains tend to stick to the rules more than small private companies but it can't hurt to ask.
