  • Bail Bonds Question

    Well, I will just tell you the aledgy story and get your opinion on it. My brother's girlfriend went to the grocery store to get her check cashed. Well she got arrested becuase there is thousands of dollars of check fraud in her name. Well here's the "story", her ex-husband basically is using identity theft. Has a checking account opened in her name and has bounced checks all over in different states. That being why she has to cash her check at the grocery store, she can't get a checking account. She says she has a laywer and has been working with the FBI on this. I guess they are about to issue her a new social. Well anyways my brother bailed her out of jail. She had told the cops what was going on and all, but she spent a little over 27 hours in jail. Now my question is if this was all a mistake on arresting her would she get they get there bail bonds money back? Assuming the whole story is legit.

    yes as long as she makes the court apperances till the charges are thoroughly investigated and either dismissed or brought to trial. But if her story works out then I would think it would all be returned.

      No Sir... Bail bonds are private owned and their responsibility is to get you out and make sure you report to court. Rather charges are dropped,found not guilty.Is of no concern to them.

        Then being that, couldn't they bring a civil suite against the city? Would the city just pay them knowing they made the mistake instead of tying up the courts with there mistake?

            correct me if I am wrong but she didn't use a bail bondsmen. her brother posted bail...which he will get back when the court case is dismissed or taken to completion.

              Youd have to sue the agency who made the arrest.... If its the FBI....Good luck you may get it done in 10 years...

                Kind of a second question, wouldn't the police department have a responsibilty to contact the FBI to check her story? If the FBI did have record would they release her then? My brothers stories have always had holes in them that didn't make sense. He's 26 and asked for my mom's help financially for the bond. He is having a baby with this girl, due end of Oct., and is talking about getting married to her soon after that. He is my older brother and has always been the one to look out for me, but I don't want him to get screwed over by her. I also think at this point he should be able to tell my mom the truth if he really needs help.

                  Im not sure..If the FBI is investigating they will take it from local authoritys..... A lawyer is probably the only one who can give you a for sure answer.GOOD LUCK Bro Is there a state Elected official from your Hometown?Its really good to know people.If so give him a call..Its his job to help his constituents

                    Shibby... you or your brother should be able to do a background check on her through your courts local website. If she has a bunch of shit on there other than passing worthless checks she is bad news. You will need to know her first, middle and last name.

                    And...usually you pay bail directly to the courts. You use bondsman when you can't pay the required amount of bail, you pay like 10%, which you won't get back, and they pay the rest....the price of freedom....get it?

                    If her story was legit and she has done no wrong, the police or whoever arrested her would have found out within 27 hours and she would have been released on her own recognizance or to your brothers custody. Somethings just not adding up there!
