    ok, so I found a apt, I have to take it by 3/1 or I can lose it. Its double the size of mine now and only 100 bucks more a month. I can also have a pet and the owner of the property is like talking to my own mother, so down to earth.

    I currently rent and have a security down on my place but don't have a official lease. The lease paper I signed was dated only thru august 2008 and not notarized or anything. I don't want to doosh the guy out of my deposit really because I am giving him 2 weeks notice and it could take him a bit of time to rent this place. Yet he wanted me to give him 2 months notice with no official lease really.

    what am I looking at.. ? lol.. I think he should possibly consider that I am willing to give up my deposit to walk away with no hard feelings as I look at it as a realtors fee almost LOL. I have been looking for a bigger place that allows pets as my daughter wants another lil teacup... so, this is probably the only shot I will get for the price. Plus it has a huge yard and a basement, washer/dryer plus I get my own 8 car driveway, I can potentially start my own SM training spot :)

    what would you all think is a way to talk this over with my current landlord. he is a pretty grumpy old italian man but also to expect someone to give up a opportunity so he doesn;t lose 2 months rent on a property that is already possibly paid off well... I gotta think of myself right :fight:

    you need to do whats best for you and your family !! i wouldnt hesitate to jump at the chance to get a bigger place that fits all my needs

      Be honest and be truthful. If he was a crappy landlord then you have a valid reason to leave. And he can't pull out the lease and threaten you for leaving early. You have a kid and their needs always come first.

        well he is not a bad landlord at all but he is a bit on the cranky side lol. I just think he will give me a hard time since he expects 2 months notice but I guess if I don't give him his 2 months he can keep my security and we should be done with it.. I have nothing in writing binding me to the 2 months either way so it would be a good faith thing. I just think its ridiculous for a landlord with how the economy and things are to als expect someone to not jump at another opportunity because he wants to ensure locking in another tenant and he won't lose anything. Either way I do only have 1 other person besides myself to think of and that is my kid, so be it

          Well since this place is so much better then yours and you are willing to walk away from your deposit I say go for it. But...I don't know what the laws are where you live but here in Cali if your lease is up and you renting month to month you need to give 30 days notice and if your 30 notice comes to some other day then the first your landlord will prorate the the days but he can't demand 60 days notice.
          I know this because I've been the building manager for my apt for the last 8 years. :)

            well the lease agreement I have clearly states 8/07 - 8/08 so would whatever is written on that document only apply through those dates? even I have nothing in writing now can he hold me to the other 30 days?

              Nope he can't your contract ended and you are on month to month bases tell him law requires 30 days notice not 60 and see what he says.

                No dont throw the laws around yet. first talk to him like a friend. Say hay I have to move I am outta here on such and such date. Bring him in your place and show him nothing is messed up and ask if you can get your deposit back a lil early. He will say no and will probably find something to keep some money but at least you get talking about it on a good note. Then if he trys any 60 day notice or what ever pull out the laws wanna was talking about. Have your kid there when you first talk to him about the money,lol. us guys are sucker for lil kids.
                The thing is be as nice as you can untill he is a complete ass then go at him. but even if he first dont bend still be nice and try and work him nicely if you see it going no where blast him,lol.

                      IDK about the legalities but remember only look out for yourself; too many times have I took other people's situations/feelings into account and it has screwed me over.

                        I agree with rocket. Also, I don't know if it the same in your state but beast is right. You're in a month to month now and you are required to give that much notice. However, your month of notice starts/stops at the time the tenancy renews. Likely the first of the month if that's when rent is due. If so you're liable, technically for all of march... Bottom line it would probably be a wash for you to walk away at the end of feb without your deposit and without paying for march

                          well it didn't work out as planned. he pulled that 2 month crap on me and of course his nephew that is a attorney told him that the contract is legally binding. Well I am gonna have to have a lawyer friend look at it myself. Some people are really money hungry.

                          All I know is that a few people went to see the place I am renting and are desperate to find a place, but I told his daughter, well sorry if someone plans to move in mid March, they are gonna have to wait till the beginning of april as I will leave some stuff here behind, I mean legally if I pay for it, it will still be mine till the end of the month or 2 months whatever it is.

                          its funny the place where I am moving now, the people were so easy going they didn't ask me to sign a lease or anything and would accept my word as good faith but some people no matter how old they are and how their mortgage is already paid off want to go to the grave with every friggin penny they can get LOL.

                          oh yeah I am pissed :fufool: people don't give 2 shits if you are single mom bla bla bla or have kids. Well oh well, life goes on.

                            i know when my cousin's landlord was giving them a tough time for leaving the lease early (written contract), my cousin got her professor, a practicing divorce lawyer, to call the landlord and bitch them out and threaten with every residential law he knew.

                            definitely give your friend a call and have them look it over. there are many ways to pull legal jargon over on someone especially when it comes to residential issues.

                              Hell ya if he makes you pay then it is yours untill that very last day. I would not let him move anyone in early, not the way he is acting.
                              I know it sucks you think the guy is money hungry cuz his property might be paid off but it is what it is. Try not to be to upset cuz he has more than you do. He is intitled to charge money for his property.
                              Have your friend look at the paperwork and hopefully you can leave with some of your cash.

                              Remember you are going to a better place for you and your girl thats most important.
