After the boss' husband told me I'm the best waiter there and got my esteem up I'm not sure if he really meant it. I mean, come on, he's been stealing from me...

Hey, maybe it's all been an accident.

"Hi boss, how are you? Hey, I learned all about wines this week. It was fun and interesting. Oh by the way, I wanted to talk to you about something. It seems you haven't paid me my hours for a few days I've worked here. An honest mistake and I understand. I hope we can fix it."

"Are you nuts?"

"No boss, look, I've been tracking my hours and dates, see? And here's the slips you give me when you pay with the dates on them. The last one you've given me was dated Oct 9th... and it's November..."

Awkward pause...

"So yes boss, I am confused. But here's a log of my hours for the past two weeks. I know for sure you haven't paid me for last week."

Just tell him you don't understand and ask him to explain.

He can't not pay you. You are protected by the state workforce commission.

I've had lots of employees and I've gone to bat for new employees when they got screwed by their previous employer before starting work for me.

As a small business owner, I can tell you you do NOT want to screw with workforce commissions, they come down on you pretty hard with fines and penalties if you get complaints or work violations.

if you kept a record of everything and made sure you didn't get your math wrong, then i don't see how he can hold your pay. just make sure it's not something that's a delayed cycle (when i worked for the census, we got paid every week for the week prior and that that week we were getting our checks). other than that i don't see how you'd have an issue.
