I bought a suit recently, had it tailored outside the store (the guy I use). I picked it up this morning, sat down, and the legs ripped slightly. I wrote a polite email. They responded in less than an hour. Just went to the store. Exchanged the suit, they are tailoring it for free, and they gave me a free dress shirt.
It is all about being polite but assertive

I just saw it was Macy's. A store like that, dislikes with a passion bad publicity. If they do not respond to your evidence, send another polite email stating that you plan on writing a letter to the editor, particularlly like a NY Times, about their lack of customer service. Further, assert that if the problem is not rectified, you will file a report with the BBB.
Better yet, skip the emails and call (if you have an hour to burn that is). You can work your way up the ladder until you get what you want.
If you want to test this theory, let's say you have cable. Pull up a satellite tv package so you have some pricing in front of you. Call to see if they can give you a deal comparable to the satellite new customer package. First person will tell you no. Say you want to cancel, you will get transferred to someone else. Explain why you are canceling and watch your bill either lower, or get free channels.

Well they sent back and did not make things right. Still saying that the guarantee is no good because the item said it was shipping from the vendor therefore it was not in stock by Macy's itself which voids the guarantee. No where did it clarify that this would not qualify. So I said to them I will no longer be shopping on their site and will be letting other people know along with my friend who is an editor at NY Times and the BBB.

Follow through on the BBB. If you file a complaint, the company has a chance to answer it. I did that once and was asked what could the company do in order that would make me withdraw my complaint.
