  • Jury Duty for Murder Retrial

Wife got summoned today. She will be excused because we have friends that are local leo that know about the case and we have talked about plus she is a stay at home mom for a child under 6 (which is an exemption).

The case is from 2004, this scumbag kid Blaine D. Ross smashed his parents head in with a bat. He got sentenced to death in 2007 but now he has been granted a retrial.

She replied in the questionaire if she knew of the case and had an opinion and she basically said yes, he's a worthless human being that does not deserve a retrial and should suffer the same fate as his parents. If for some reason the baby exemption doesn't work I'm sure her strong and biased opinion will seal the deal, lol.

They tell you in bold print in the summons that you cannot research the case by any source of media nor can you discuss the summons with anyone. The packet of do's and don't is pretty thick.

"Ross, 29, is accused of beating his parents to death with a baseball bat in January 2004. In 2007, he was convicted of first-degree murder and robbery and was sentenced to death.

He was the first person in nearly 20 years sentenced to death in Manatee County.

But the Florida Supreme Court later ordered that Ross have a new trial after "justices ruled that Manatee County Sheriff’s Office Detective William Waldron violated Ross’ Miranda rights by taking him through several hours of grueling questioning without reading him his rights first. Miranda outlines a person’s right to remain silent and to obtain an attorney," a 2010 Bradenton Herald article reads.

Three dissenting judges pointed out that Ross signed a waiver of his rights just before confessing to the slayings, the article said."

I think I would like to do that....if it was a different scenario. I did get picked for something small within my city. It's sort of interesting. But at the same time, I don't like deciding peoples fate!

A friend of mine was part of a murder trial for to teenage gang members that shot a kid then drug his body around town behind their vehicle. Gang members hung around the courthouse and ended up following jury members home. Later throughout the 3 month trial his garage got set on fire.

I was only summoned once. And even that time, I had to call a phone number the day before to see if I needed to show up and the trial got cancelled or something, so I never went in. I know others who have been called 3 or 4 times, so not sure what algorithm is used to pick people.

That is so scary! No wonder nobody wants to risk being on those juries.

This case is not going to retrial. They reached a plea deal for life in prison with no possibility of parole instead of his original death sentence.
