Because if a white kid did that to a black kid that's immediately what it would be classed as

It would not, false. The times that it does happen, usually the attacker has said stuff to indicate it being a hate crime or some sort of inclination of it.

I see your view though, but i don't agree with your first post of why it's not a hate crime.

I've just seen too many cases where for example; blacks have said racist stuff while attacking whites and nothing got said in the sentence to reflect racism. Switch it round and first assumption is race attack.

That's just how it is it seems and here is no different in that if a white kid did that to a black kid the first assumption is racism and police would interview on that basis
