  • Legal Question About Apartment

    So we've been at our current place 2 years, always paid rent on time never had any problems etc..

    Yesterday there was a paper tapped to my door basically saying "you have a restricted breed (pitbull) and you either get rid of her or you break your lease and move out". It says we have 3 days to make the decision.

    Now obviously nothing on earth is going to make me get rid of my baby so that's not an option.

    Here's my main question. How much time do we actually have before they can literally come and kick us out? Obviously it takes more than 3 days to find a new place to live. I'm sure there is some legal amount of time they must give someone to find a new home. Again, we always pay our rent and bills etc.. we are only guilty of having a dog breed that isn't allowed in the apartment complex. I guess I'm just asking what our options are in terms of time to find a new place before they can legally kick us out? I feel like we need at least 30 days to properly find a new place and move out.

    Give them your 30 day notice and you'll be ok.
    Believe me they don't want spend money on lawyers or the eviction process.

      3 days? Geez... they give us 90 days here...
      Why would it take them this long to figure out that you have a pit?... I'm not familiar with stateside laws, but sounds like you need to lawyer up

        what about breaking the lease? what kind of bullshit can we expect from that? we obviously don't want to break the lease we are being forced to do it.

        the funny thing is, we got this notice literally 1 month after we renewed the lease. something about the timing feels very fishy. by allowing us to sign a new lease they know we are kind of trapped in with fees. had they given us this notice a month earlier we would never have renewed the lease.

        i guess we can kiss our $2000 security deposit we paid to move in good bye?

            it's just 3 days to let them know what we are gonna do. i'm just trying to figure out how much time we actually have before they can legally kick us out. like do we have 30,60,90 days?

              72hrs to basically take action or they will take theirs on you.


              It's minimal for them to file eviction, it happens all the time. The attorneys they use are newbies who are paid minimal, so them taking you to court is no issue at all

                Pretty much the exact opposite what beast told me.

                But regardless, the eviction process is not a quick matter. It's a process and during the eviction process they aren't allowed to take money from us even if we try to pay our rent. So if that's the course they want to take be my guest. They are required by law to give us a reasonable amount of time to find a new place to live.

                  Believe what you want. But I can tell you that anyone filing motions these days and attorneys, are minimal unlike 5yrs ago bro.

                  It's a good 30 to 45 days when it's all said and done for getting people out.

                  Yes they don't collect monies, you actually pay the clerks once it goes to eviction

                    This is California bro. Lot of safeguards in place to keep landlords from tossing you out overnight.

                    Again, it's not like we aren't paying our rent. It would be silly to start an eviction process while we are paying our rent and agreeing to break the lease and move out.

                    I seriously doubt they want to get the lawyers involved with paying tenants who are actively working with them and agreeing to move out.

                    We simply need more than 3 days as would anyone.

                      Someone doesn't need to NOT pay rent for them to be evicted. I've seen many people get tossed out mainly because of pets and restrictions....i know the leasing laws are different in many states, but certain guidelines are the same standards all across the board for rentals.


                      Good luck either way, but I can tell you that your options are getting rid of dog or moving out....it sucks, I get it. Kinda surprised to be honest, this hasn't happened long time ago.

                      The places I have in Boston, CT and RI....those types of breeds are forbidden and will get anyone tossed out quickly.

                        So the whole time you been there did you know about the dog breed restrictions? Sounds like to me you got a neighbor that reported n complained. If ya knew of the restrictions...And said screw it I'm doing it anyway.,it was only a matter of time bro and honestly you should of been expecting it.

                        I could be wrong...But it sounds like you have 3 days to inform them of your decision. Then you'll be told how long you have to get out when you notify them. Good luck with it.

                          Well i just talked to a guy that manages apartments in California. He told me to tell them my dogs are service animals. He said his apartments don't allow animals at all but if someone mentions the words service animals there is pretty much nothing he can do because of the laws in California. They can't even ask very many questions about it. That's the route I'm going to try. You don't have to be physically handicapped to have a service animal, it can even be an emotional thing.

                              Yea it's a very real thing. This guy manages apartments that do not allow animals. But he can't even charge pet rent if someone has a service animal. And like I said, due to California privacy laws the apartment cannot ask very many questions about it.
