    Even after blood tests confirmed that Ebner, Mbamara, and Oriyomi were telling the truth when they denied being under the influence of marijuana, the Cobb County Police Department defended Carroll's methods. Amazingly, the complaint notes, his superiors "continued to state that even if Defendant Carroll had known of the negative results of Plaintiff Ebner's blood test at the time she was arrested, nonetheless there would have been probable cause for her arrest."

    Do NOT, under any circumstance, consent to a field sobriety test. You can legally refuse you take one. Two reasons - even sober people will have a hard time not messing you that test, and secondly, it is entirely subjective. If the cop says you failed, you failed.

      Don't consent to anything. DO NOT talk to the cops. They are not your friend. It won't make anything better. If you are in a serious situation shut your mouth and call a lawyer.

        And don't get me started on drug dogs.....it is ridulous that such a method is even acceptable. They should not exist. They can't take the stand. They work on cues.

          Yeah, the drug dog is the loophole the cops use to get around 4A protection. Even if you refuse a search, the cops can claim the dog detected something and that amounts to reasonable suspicion in the court's eyes. And like you said, the dog just responds to cues, not to any odor.

            The 4th, 5th and 6th amendments are your best friend. Start recording, claim your constitutional rights and let your lawyer take it from there.

                    refusal of field test is bad idea (at least in NYS) you will be hit with serious fines and penalties worse than the DUI. the cop can testify your refusal. its a mandatory 1 year with license suspended, jail, fines, ignition lock ... the court sees the refusal basically saying you knew you were intoxicated.

                    if you already have a DUI refusal may be better...

                      My buddy refused a breathalizer and in Illinois it's automatic 6 month suspension of license but they prob smelled liquor on him lol.

                          I think you are mixing two different things.

                          You can refuse the FIELD SOBRIETY test. That the test where they make you walk back and forth to see if you are wobbly. The reason to refuse this is that it is a bogus test that even most sober people will fail, and if the cop wants you to take it, he's already made up his mind that he's going to fail you.

                          Refusing the breathalyser is more problematic because that can result in loss of driving privileges, etc.

                          So, refuse the field sobriety test and ask to call a lawyer before going any further. The lawyer can help you decide how to deal with the breathalyser.

                          Of course, double check the laws in your jurisdiction.
