The key is consistency. The defense was always consistent. They said throughout - it was a tragic accident. Now, you can argue whether this merited an involuntary manslaughter conviction or not. I don't know exactly why the jury throughout there was reasonable doubt there - I haven't looked into that aspect closely enough.
Look at the prosecution on the other hand. In the beginning, it was "an oafish man," then it became an "out-and-out assassin on the hunt for a victim; he'd furtively transported a gun to a "target-rich environment." Halfway through the trial they decided to up the ante and tack on a first degree murder charge with no evidence that he was intending to shoot someone, which is what first degree murder is - premeditated with wilful intent to kill. That's a pretty big stretch.
The jury saw through it. They knew that the prosecution was throwing the book at this guy and called them out on their BS.
The trouble I am having is the narrative that this is some kind of nefarious liberal plot from Californistan. Again, read through the article. It is worth it. Explains a lot about how it all went down.

Two totally different things are being conflated here.
First, the fact that this guy is illegal is irrelevant to the case. Making a case for the wall because of this one guy makes about as much sense as a situation where, if an illegal alien saves someone by giving them CPR, we say we should let everyone in because of what this one person did. The shooting should be dealt with on its own merits, regardless of this guy's immigration status.
The second totally separate issue is that of illegal immigration in this country and the absolute refusal by our politicians to have a reasonable and comprehensive solution for it. It has nothing to do with this case

DEL RIO, Texas -- An amended federal arrest warrant has been released for Jose Ines Garcia Zarate, a Mexican man acquitted Thursday in the killing of a woman on a San Francisco pier, a case that's sparked national debate over immigration.
The warrant says Zarate violated his supervised release on a federal sentence for illegally re-entering the U.S. by possessing the gun that killed Kate Steinle on July 1, 2015. The warrant was originally issued July 14 of that year but an amended warrant was unsealed Friday following the verdict.
The warrant issued by the U.S. District Court for the western district of Texas says Zarate was sentenced in Texas on May 12, 2011 to 46 months in prison, followed by three years of supervised release, for illegally re-entering the U.S.
The warrant says the terms of the supervised release, which began March 26, 2015, barred Zarate from committing another crime and from possessing a firearm. He was still bound to the terms of that release when Steinle was shot and killed. Though he was acquitted of murder Thursday, he was found guilty of being a felon in possession of a firearm.
President Trump called the acquittal a "complete travesty of justice," and U.S. Attorney General Jeff Sessions demanded cities like San Francisco scrap immigration policies barring cooperation with federal deportation efforts.
Thousands of Twitter users turned to the hashtag #BoycottSanFrancisco. Conservative politicians and celebrities such as former Alaska Gov. Sarah Palin and actor James Woods lambasted the city.
City officials pushed back and vowed to stand behind their so-called sanctuary city policy. It's what led Garcia Zarate to be released from San Francisco's jail despite a federal request to detain him for deportation several weeks before Kate Steinle was fatally shot in the back. He had been deported five times before.
Hundreds of cities have similar policies, which Trump, Sessions, and others blame for Steinle's death. San Francisco has consistently been an early adopter of some of the most immigrant-friendly policies nationwide, expanding protections to residents living in the country without documentation.
"San Francisco is and always will be a sanctuary city," said Ellen Canale, a spokeswoman for Mayor Ed Lee.
The warrant says that Zarate was released from the custody of the Federal Bureau of Prisons to Immigration and Customs Enforcement after completing his prison sentence for illegal re-entry on March 26, 2015. He was then transferred to the custody of the San Francisco County Sheriff's Department to face a then-pending charge for selling marijuana from 1995. That charge was dismissed the following day and he was released by local officials, despite a request from federal officials to detain him for deportation.
Prosecutors had charged Garcia Zarate with murder, assault and being felon in possession of a firearm in Steinle's death. He called the shooting an accident. He said he found a gun under a chair on the pier and it fired when he picked it up.
San Francisco Deputy District Attorney Diana Garcia urged jurors to convict him of first-degree murder. Jurors also considered and rejected second-degree murder and involuntary manslaughter.
They did convict him of the firearm charge, which carries a maximum sentence of three years in jail. U.S. Immigration and Customs Enforcement said it would "ultimately remove" Garcia Zarate from the country.
"San Francisco's decision to protect criminal aliens led to the preventable and heartbreaking death of Kate Steinle," Sessions said in a statement Thursday night. "I urge the leaders of the nation's communities to reflect on the outcome of this case and consider carefully the harm they are doing to their citizens by refusing to cooperate with federal law enforcement officers."

i agree 100%. if scrum was walking with his child like this father was walking with his daughter and suddenly he is holding his child as he takes his last breath. he looks up and the guy who pulled the trigger is running away. then as he sits in court the verdict is nothing more then to be sent back home which has already happened to him 5 times before. i don't believe for one minute scrum would take this stance of "the law is the law and that's how it is, blame the prosecutor". fuck that shit. there are situations in life where justice must be done. this POS took away this young womens chance at life and he gets to continue living his.. no way is that right. i don't care what the law says and like rado said, i would do everything in my power to kill this mother fucker myself if this happened to me.Originally posted by lipripper View PostGood. I also blame the prosecutors they went after un-realistic charges. Murder is def not what happened involuntary manslaughter - felon in passion with a firearm - and what ever the charge is for shooting in a public area.
if I was the dad that man would of died that same day and if not he would of died the day of the trial. I will die killing him if had to be. my brain can not even process that kind of pain.
I do believe it was an accident but holly shit it would not matter if it was my kid.
anyone of us can run someone over tomorrow on accident and I would not want to goto prison forever for a accident. thats just a shitty thing all the way around. best thing I can think of is if he wasn't here it wouldn't have happened.

Nowhere did I say that they guy deserved to walk. I said that I can fully see why this guy didn't get murder 1, but I don't understand why he didn't get manslaughter. Maybe there was some detail that the jury had to work with that didn't come out in the news reports.
My only point, and this is something that you guys keep glossing over, is that this has NOTHING to do with his immigration status. Saying things like "this wouldn't have happened if he wasn't here illegally" is technically correct, but silly. It is an irrelevant point that is being used as a rallying cry for building the wall, etc. That is such garbage. So, if they guy instead had saved a drowning child who fell off the San Francisco pier, we would be saying "oh boy, illegals are so great. If he wasn't there, the child would have drowned?"
Also, I never said illegal immigration is not an issue. The problem is that the politicians are so incompetent, they can't fix this. And you are not going to fix this with a wall. You are going to fix it by creating a LEGAL way for these guys to come up north and work. That's the way to fix it, not buy spending billions on a stupid wall.
The point is I am making is that this was a tragedy, an accident. I am not sure why he didn't get manslaughter. The prosecution totally messed up. And finally, this has nothing to do with immigration and using this for wall propaganda doesn't make any sense.
