  • BlackStone Labs in legal trouble

Two Boca Raton dietary supplement companies and six individuals have been charged with conspiracy to distribute unapproved drugs and controlled substances, the Department of Justice said.

The companies are Blackstone Labs, located at 1090 Holland Drive, Suite 1, and Ventech Labs, at 1140 Holland Drive, Suite 13, in Boca Raton.

The people charged in the 14-count indictment returned by a federal grand jury were: Phillip Braun, 38, of Boca Raton, Aaron Singerman, 39, of Delray Beach, Robert DiMaggio, 49, of Henderson, Nev., Anthony Ventrella, 41, of Boynton Beach, David Winsauer, 32, of Boca Raton, and James Boccuzzi, 34, of Parkland.

The indictment alleges that the defendants sold hundreds of thousands of illegal products, including steroids. The indictment says they distributed the products, knowing they were “unsafe or could not legally be sold to consumers.”

“Fraud by supplement manufacturers and distributors is extremely dangerous for consumers, who rightly assume that a dietary supplement product sold in stores or online will not contain unapproved drugs,” said Assistant Attorney General Jody Hunt for the Department of Justice’s Civil Division.

Braun’s lawyer, Ben Kuehne of Kuehne Davis law firm in Miami, sent a statement from Blackstone Labs and Braun calling the charges “false and inaccurate.”

Blackstone Labs plans to fight the charges, according to the statement, which it says are “overreaching” as part of a government agency “attack on strength and bodybuilding athletes and the nutritional supplement industry.”

Braun is listed as manager of Blackstone Labs, according to the Florida Division of Corporations. Ventech manufactured products for Blackstone Labs, according to the indictment. No one could be reached for comment at Ventech Labs on Monday despite phone calls and an email.

The indictment was unsealed last week in U.S. District Court, Southern District of Florida.

All defendants were charged with one count of a conspiracy to defraud consumers and the Food and Drug Administration by selling products labeled as dietary supplements that contained unapproved new drugs, illegal steroids and other ingredients that were hazardous and prohibited by law.

The indictment also charges Braun, an owner of Blackstone Labs, and Singerman, a former company owner, with two counts of introducing a product known as Super DMZ RX 2.0, an unapproved new drug, into interstate commerce.

Sentences range from three years to 15 years for the various counts including conspiracy, according to the Department of Justice.

      Could RedCon1 come under fire?
The bodybuilding and fitness community was left in shock last week after news broke that prominent supplement company Blackstone Labs was slapped with indictment charges by the federal government. It has certainly become of a point of contention with many people weighing in on whether Blackstone Labs would be able to survive after facing these alleged charges. But where does Aaron Singerman and his supplement company RedCon1 fall in this matter?

When supplement companies to package products telling their customers that everything used within these items are above board, safe to use, and are of top quality when the reality is completely different, you set yourself up for a hard fall. PJ Braun has already made it clear that he and Blackstone Labs will be fighting these alleged charges, but where does this leave Aaron Singerman and RedCon1?

While Aaron Singerman has been named in the indictment, RedCon1 itself hasn’t come under fire by the federal government. At this point, it can’t be assumed that RedCon1 will be faced with the same charges as Blackstone Labs. It is a point of consideration that since Aaron Singerman has been named in the indictment, RedCon1 could be effected in some form.

All the charges brought against PJ Braun, Aaron Singerman and Blackstone Labs have yet to be proven by the federal government however. But as the investigation continues, there’s a possibility that the government may set their sights on RedCon1 next, simply due to Aaron Singerman’s involvement. If the government does indeed find that the operations conducted by Blackstone Labs was illegal, and if Aaron Singerman used alleged illegal money earned under the Blackstone Lab name to start his own supplement company, then RedCon1 could certainly come under fire. Should the federal government prove their case, particularly where the money laundering charges are concerned, it means that the federal government will seize any assets involving Blackstone Labs.

While it is uncertain whether Aaron Singerman founded RedCon1 with funds earned while working under the Blackstone Labs umbrella, if the federal government can prove their case it could potentially effect the flourishing supplement brand.

It doesnt appear that REDCON offers products like Blackstone Labs did at one point such as Super DMZ. The money laundering allegations are where REDECONs problems can stem from. I don't know these guys but certainly wish them the best in their upcoming battle.
